GENERAL TERMS AND CONDITIONS

Welcome to Ecoembal. Before using our website and/or contracting our services, please read these Terms and Conditions carefully. By accessing or contracting, you agree to be bound by them. If you do not agree, do not use or contract.

1. Purpose

Ecoembal provides packaging waste management and recycling services and/or markets related products (hereinafter, "the Service"). These Terms regulate the use of the website and the contracting of the Services.

2. Users and capacity

a) Only natural persons of legal age or legal entities duly represented may contract.
b) By registering or contracting, the Client declares that the data provided are true, complete and current. Any changes must be communicated immediately.

3. Recruitment process

a) Prices: all prices include VAT and, if applicable, official taxes and fees.
b) Order: it will be considered accepted when Ecoembal confirms in writing (e-mail).
c) Payment: by the methods indicated on the website. Non-payment or delay gives the right to suspend services, demand late payment interest (equivalent to the legal interest plus 2 points) and claim compensation for recovery costs.

4. Delivery and deadlines

a) Estimated delivery times: indicated in the order confirmation. They do not constitute an essential term unless expressly agreed.
b) Delays: in the event of delay, Ecoembal will inform the Client and offer a new date; penalties and indemnities will not be accepted except in the case of wilful intent or gross negligence.

5. Right of withdrawal

a) Consumers: they have 14 calendar days from receipt to cancel without penalty, except for legal exceptions.
b) Procedure: communicate in writing (e-mail). The Customer assumes the direct cost of return if so agreed.

6. Warranties and claims

a) Products: legal guarantee of conformity of 2 years (art. 114 RDL 1/2007).
b) Services: guarantee of good execution; any defect must be notified in writing within a maximum period of 14 days from the date of delivery.
c) Exclusions: damage resulting from misuse, negligence or unauthorized modifications.

7. Responsibility

a) Limit: except for personal injury or liability unavoidable by law, Ecoembal's total liability is limited to the amount paid by the Customer for the order or service in question.
b) Indemnification: The Client shall indemnify Ecoembal against claims by third parties arising from false information, improper use or failure to comply with its obligations.

8. Force majeure

Ecoembal shall not be liable for non-compliance due to causes beyond its reasonable control (strikes, fires, natural disasters, pandemics, administrative regulations, etc.). Deadlines will be extended by the same amount.

9. Intellectual Property

All content, designs, logos and trademarks are the property of Ecoembal or its licensors. Their reproduction, distribution or transformation without express authorization is prohibited.

10. Data Protection

Ecoembal complies with current legislation on data protection (RGPD and LOPDGDD). For information on data processing and exercise of rights, please see our [Privacy Policy].

11. Modifications

Ecoembal may revise these Terms at any time. The applicable version will be the one published on the website on the date of contracting or access.

12. Legislation and jurisdiction

These Terms are governed by Spanish law and applicable European regulations. For the resolution of disputes, the parties expressly submit to the Courts and Tribunals of Madrid, unless the law requires another jurisdiction.
